Real Estate Terms & Conditions: This is a cash sale. Potential buyers must have their financial arrangements secured prior to bidding. There will be no buyer contingencies offered or accepted for financing, inspections, or appraisals. Immediately upon conclusion of the auction the high successful bidder(s) will be required to sign a Real Estate purchase agreement contract and to deposit with the closing agency, Mellette County Title Company at 302 East 2nd Street, Winner, SD, a ten percent (10%) nonrefundable earnest money payment. Balance of the purchase price is due in certified funds at closing on or before July 15, 2018. Conveyance of Marketable Title will be transferred by Warranty Deed, free and clear of liens but subject to all easements, covenants, leases and restrictions of record, as well as statutory rights of way. Seller’s title insurance policy will be provided prior to the auction for the buyer’s inspection. Tract 1: 192.0 +/- Acres. According to Mellette County Farm Services records this tract has 102.63 +/-acres of grass and 89.37 +/- acres of farm ground.
The Big White River runs along the entire north side of this tract. This tract also has two private wells, a 2-bedroom home, machinery pole building, some livestock corrals, and a couple of outbuildings used for livestock. In lieu of a previous oral lease agreement, Buyer(s) will become Landlord(s) at the time of closing with the option to terminate current lease for the 2019 season. Landlord(s) would be required to notify lessee by legal written notice prior to September 1, 2018 to terminate current lease. Oral lease agreement grants Landlord 1/3 of the harvested crop without expense and ½ of the hay crop without expense.
The water source that is currently being used for this home is currently not in working order. There is another well on this tract that could be used as the water source for this home.RE Taxes $ 1,211.06.

Tract 2: 188.16 +/- Acres. According to the Mellette County Farm Services records this tract has 184.29 +/- acres of pasture. This tract has a graveled SD highway 53 running along the entire west side of this property and the other 3 sides have a low maintenance county road beside it. This pasture has two small ponds and a water tank fed by a private well located on Tract 1. This property is being sold with immediate possession after closing. This pasture was not grazed last summer. Tract Two has a 40 acre parcel that is being leased by the Seller from the Rosebud Sioux Tribe.
